So you think you are being or have been discriminated against by your employer? What Now?
Communication and Documentation!!!
1. Look at your workplace policy to determine if your employer is following the policy or has deviated from it.
2. Document all incidences of what you perceive to be discrimination or harassment. Indicate who made what comments, when, what employees were given better treatment, and similar information.
3. Compare and document whether you are being treated differently than other employees in your same position.
4. Do not engage in the same type of conduct that you are complaining about.
5. If possible, engage your employer in a discussion about what type of accommodations can be made.
6. Follow your employer’s guidelines for reporting incidences of harassment/discrimination, such as notifying the Human Resources Department.
7. Call the EEOC and/or an attorney if you have questions about filing a charge of discrimination. An EEOC charge must be filed within 180 days of the discrimination. Filing an EEOC is a prerequisite for filing a lawsuit, unless you have a claim solely under the Equal Pay Act3.
